TERMS AND CONDITIONS OF SITE USE AND ONLINE SALES

1. General Provisions. Seller Information
These Terms and Conditions ("Terms") govern the use of the website www.pumamoldova.md ("Site"), the placement and processing of orders, as well as the legal relationship between the consumer and the seller regarding the purchase of goods through the online store.

These Terms are supplemented by the Personal Data Processing Policy, Cookie Policy, Return/Contract Withdrawal Policy, and other mandatory documents published on the Site, to the extent that they apply.
Legal relations are governed by the legislation of the Republic of Moldova, including the Civil Code, Law No. 105/2003 on Consumer Protection, Law No. 284/2004 on Information Society Services, Law No. 195/2024 on Personal Data Protection, and other applicable regulatory acts.
GHS-COM reserves the right to amend these Terms when necessary. Amendments do not affect orders/contracts already concluded prior to their publication, except in cases permitted by law or agreed upon by the parties. The version of the Terms in effect at the time of order placement applies to the order.
2. Definitions

Consumer — a natural person acting for purposes outside their commercial, industrial, production, or professional activity.

Customer/Buyer — a person using the Site and/or placing an order.

Product — the goods offered for sale on the Site.

Order — an electronic request submitted by the Customer through the Site to purchase one or more Products.

Distance Contract — a contract concluded between GHS-COM and the Consumer without the simultaneous physical presence of the parties, using distance communication tools.
3. Use of the Site and Acceptance of Terms
Before completing an order, the Customer is given the opportunity to review these Terms and essential information regarding products, pricing, delivery, payment, and consumer rights.
By checking the "I have read and agree to the Terms and Conditions" box and submitting the order, the Customer confirms acceptance of the Terms applicable to that specific order.
Acceptance of these Terms does not constitute consent for marketing communications and does not replace separate consents required by personal data protection or electronic communication laws.
4. Products, Information, and Prices
GHS-COM takes reasonable measures to ensure the accuracy and currency of descriptions, images, sizes, colors, prices, and product availability information.
Images are for illustrative purposes. Reasonable variations in shades due to the user's screen or device may occur; this does not limit consumer rights in the event of an actual product non-conformity.
The price indicated at the time of placing the order applies. Delivery costs and other applicable expenses are communicated prior to order completion.
In the event of an obvious technical or material error regarding price or product availability, GHS-COM will inform the Customer without undue delay and offer the option to confirm the order under the correct terms or, if necessary, cancel the order and refund any paid amounts.
5. Order Placement and Contract Conclusion
To place an order, only data necessary for its execution may be requested from the Customer, including first and last name, phone number, e-mail address, and delivery address/pickup point. If the recipient is a third party, the Customer must provide only the data necessary for delivery and ensure they have the right to share such data.
After submitting an order, the Customer receives an electronic confirmation of receipt. If, according to the Site's technical process, the initial confirmation only acknowledges receipt of the order, the contract is deemed concluded upon confirmation of processing/acceptance of the order by GHS-COM.
GHS-COM has the right to refuse processing or cancel an order only for objective and legitimate reasons, such as product unavailability in stock, impossibility of performance, reasonable suspicion of fraud/abuse, obvious technical error, or inability to confirm data necessary to fulfill the order. The Consumer will be notified, and any paid funds for canceled orders will be refunded according to the law.
The provision from the previous edition allowing automatic order rejection based on the number of previously declined products/orders does not apply automatically; any abuse prevention measures must be justified, proportionate, and not unreasonably limit consumer rights.
6. Payment Methods
Available payment methods are indicated on the Site and/or on the checkout page. These may include online payment by bank card, card payment upon delivery (if available), and cash payment (if provided).
For online bank card payments, full card details are entered into a secure environment provided by the payment service provider and are not stored by GHS-COM, provided the current technical architecture of the payment process is configured accordingly.
Payments and refunds are executed in the currency and methods permitted by applicable law and the payment service provider.
7. Delivery
Product delivery is carried out by courier service providers engaged by GHS-COM, including FAN Courier, under the conditions and rates communicated to the Customer before order completion.
Estimated delivery times and costs are stated on the Site/checkout and/or communicated to the Customer upon order confirmation. Delivery times may vary depending on the location, product availability, courier service schedule, and objective circumstances beyond GHS-COM's control.
GHS-COM transmits to the courier only the data necessary to complete the delivery, in accordance with the Personal Data Processing Policy.
Upon receiving the parcel, the Customer is advised to inspect the packaging integrity and check for visible defects. This inspection does not limit or terminate the consumer's legal rights regarding non-conformities discovered later.
The provision in the previous version stating that the Customer cannot make claims against GHS-COM after receiving the product has been removed. Consumer rights cannot be restricted by such a clause.
8. Right of Withdrawal from Distance Contracts
In accordance with applicable distance contract legislation, the Consumer has the right to withdraw from the contract within 14 calendar days without giving any reason.
For product sales, the withdrawal period generally begins on the day the Consumer or a designated third party (other than the carrier) takes physical possession of the goods; special rules apply for multiple shipments as provided by law.
To exercise the right of withdrawal, the Consumer must send an unequivocal statement of their decision to withdraw to GHS-COM before the period expires, via the channel specified on the Site for returns/withdrawals. Simply refusing or failing to collect the parcel does not substitute the formal withdrawal notice required by law.
The Consumer must return the product without undue delay and within the legal timeframe. Direct return costs are borne by the Consumer if they were informed in advance and unless GHS-COM decides to cover those costs.
The Consumer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
The right of withdrawal does not apply in cases expressly excluded by law, including sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed by the consumer, as well as other cases explicitly stated in legislation.
9. Refunds Upon Withdrawal
In the event of a valid exercise of the right of withdrawal, GHS-COM will refund all eligible payments without undue delay and within the statutory timeframe, generally using the same payment method used for the initial transaction, unless the Consumer expressly agreed otherwise.
GHS-COM reserves the right to withhold the refund in cases permitted by law until receiving the returned goods back or until proof of return shipment is provided—whichever occurs first.
Additional costs resulting from the Consumer's choice of a delivery method other than the standard delivery offered by GHS-COM are non-refundable to the extent permitted by law.
10. Product Non-Conformity, Complaints, and Warranties
The right of withdrawal from a distance contract is independent and distinct from consumer rights regarding product non-conformity.
GHS-COM is liable for product non-conformities in accordance with Law No. 105/2003 on Consumer Protection and other applicable standards.
The Consumer may confirm the purchase using a sales receipt or any other document/means allowed by law that identifies the transaction.
The previous rule stating that claims could only be satisfied within 30 days and exclusively for "manufacturing defects" no longer applies. Remedies and timeframes are determined by the nature of the non-conformity and governing laws.
Complaints may be submitted via GHS-COM’s contact details provided in these Terms and/or through the customer support channels on the Site.
11. Personal Data
Personal data processing related to Site usage, user accounts, orders, payments, delivery, returns, loyalty programs, and Customer interaction is conducted in compliance with Law No. 195/2024 on Personal Data Protection and the Personal Data Processing Policy published on the Site.
Data necessary for placing and executing an order is not processed under a "general consent", but on the appropriate legal basis, including contract performance and legal obligations.
Acceptance of these Terms does not constitute consent for commercial messaging. E-mail, SMS, and other marketing channels are regulated separately and require explicit, freely given, and revocable consent.
GHS-COM reserves the right to transfer necessary data to service providers involved in service execution (couriers, payment gateways, IT/hosting, CRM, and communication services) strictly within the limits outlined in the Privacy Policy.
References to GHS-COM’s operator registration under No. 0001929 and claims that data is never transferred to third parties (except public authorities/courts) have been removed, as they do not reflect modern e-commerce processes.
Furthermore, clauses stating that data transmission over the Internet is "at the Customer's own risk" have been removed. GHS-COM is obligated to implement technical and organizational measures to ensure data security.
12. Cookies and Analytics/Marketing Technologies
The Site uses cookies and similar technologies in accordance with the Cookie Policy. As of this version, active technologies may include Google Analytics, Google Ads, Google Tag Manager, Microsoft Clarity, Meta Pixel, and TikTok Pixel.
Optional cookies and marketing/analytics technologies requiring consent will not be activated prior to user selection. The Site provides options to accept, reject, and configure optional cookies, as well as modify preferences at any time.
Cookie consent is strictly separate from accepting these Terms and agreeing to commercial messaging.
13. Customer Account and Loyalty Program
If the Site offers customer accounts or a loyalty program, specific participation terms are communicated during registration or published separately.
Participation in a loyalty program does not automatically grant marketing consent. Commercial communications are managed separately according to user choice and law.
14. Electronic Communications
Transactional messages regarding order confirmation, processing, delivery, payments, returns, and complaints are operational communications and are not classified as marketing.
Commercial messages will only be sent in compliance with applicable law, and users can opt out at any time through provided unsubscribe mechanisms.
15. Liability
GHS-COM is liable to the Consumer within the limits established by law.
Nothing in these Terms excludes or limits mandatory legal rights of the Consumer or GHS-COM's liability where such restrictions are prohibited by law.
GHS-COM is not liable for failure to fulfill obligations due to force majeure or unforeseen circumstances beyond control as recognized by law, without prejudice to its obligation to notify the Consumer.
16. Intellectual Property
All Site content—including text, graphics, structure, photography, logos, and trademarks—is used by GHS-COM under legal rights and authorizations. Unauthorized commercial use of Site content is strictly prohibited.
17. Complaints and Dispute Resolution
Customers are encouraged to contact GHS-COM first to resolve any issues amicably. This does not restrict the right to contact regulatory authorities or initiate legal proceedings.

18. Applicable Law and Jurisdiction
These Terms are governed by the laws of the Republic of Moldova.
Any disputes that cannot be settled amicably shall be brought before competent courts in accordance with mandatory consumer protection jurisdiction rules.

20. Final Provisions
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions remain in full force, and the invalid clause will be replaced by the mandatory legal provision.
These Terms must be interpreted alongside the Personal Data Processing Policy, Cookie Policy, Return Policy, and internal GHS-COM procedures.
